Some exchange visitors with J-1 visas are subject to a two-year home-country physical presence requirement. It requires the participant to return home for at least two years after their exchange visitor program. This requirement is part of U.S. law, in the Immigration and Nationality Act, Section 212(e).
If you wish to petition them for H1B they need a Waiver that can be obtain through Department of State, we are happy to refer you to our legal immigration partner.

The duration of stay of the participant is 5 years, Initially they will be given a 3-year DS2019 and visa validity, they can extend their stay after the 3rd year with 1 year increment.
